One of doctoral student Jason Martin’s articles has been cited in a decision by the United States District Court for the Southern District of West Virginia, Fourth Circuit.Martin's article, "Reversing the Erosion of Editorial Diversity: How the Newspaper Preservation Act Has Failed and What Can Be Done," was published in Communication Law & Policy in January 2008.
Judge John T. Copenhaver Jr. quoted the article in denying a motion by the defendants to dismiss the case of United States v. Daily Gazette Company and MediaNews Group, Inc., on June 19, 2008.
Martin's article examines how the Newspaper Preservation Act of 1970 and the joint-operating agreements it created sometimes have been subverted to create monopolies. The case in question concerns the Charleston Gazette's alterations to the Charleston JOA, which the plaintiffs allege were designed to put the partner Charleston Daily Mail out of business.
Copenhaver quoted Martin's article in a passage that placed the case into the context of historical developments in JOA ownership.
