Associate professor Anthony Fargo is the first author of an article accepted for publication in the Harvard Journal of Law and Public Policy. The article, co-written by Laurence B. Alexander, a professor of journalism at the University of Florida, is called “Testing the Boundaries of the First Amendment Press Clause: A Proposal for Protecting the Media from Newsgathering Torts.” The article proposes that judges view journalists working undercover to expose criminal and unethical behavior as “testers.” Testers are protected under the law from various torts, such as fraud and misrepresentation, when they pose as home buyers or job seekers to test compliance with federal anti-discrimination laws. The article is scheduled for publication early this summer.
