A law review article published by associate professor Anthony L. Fargo has been quoted in a decision by the Arizona Court of Appeals. In Flores v. Cooper Tire and Rubber Co., a three-judge panel upheld the right of a television reporter to withhold the identity of her confidential source. The court quoted Fargo’s article "The Year of Leaking Dangerously: Shadowy Sources, Jailed Journalists, and the Uncertain Future of the Federal Journalist’s Privilege," which was published in 2006 in the William & Mary Bill of Rights Journal. The legal citation for the court opinion is 178 P.3d 1176 (Ariz. Ct. App. 2008).
This is the second time a Fargo article has been cited by a court. A 2002 federal district court case, Hade v. City of Fremont, cited a previous Fargo article. Both the case and the article dealt with the rights of journalists to protect non-confidential materials, such as notes and unpublished photographs, from being used as evidence in court.
